Concealed Knife Carry in Canada?
Concealed carry in Canada is illegal in any way shape or form but I am wondering what is considered concealed. I have a 3.6 inch folding spring assist knife with pocket clip; the CRKT My Tighe to be more specific. From what I understand this knife is completly legal but I don't want to get in trouble for having it so called concealed. I have no intension to use this as self defense I use my knife as a tool only not a weapon. So to the point can I put this knife in my pocket using the pocket clip? Because it really isn't concealed it can still be seen easily some people may not know what it is but it is still visible. Or is this illegal. Also would holding it in an exterior sheath on the belt be a legal alternative? Thanks in advance.
A spring assisted knife may still be considered a prohibited weapon under the Criminal Code.
I am not a knife expert, and I have read the sites saying it is legal, but it comes down to a technicality.
The code states "any knife that has a blade that opens automatically by gravity or centrifugal force, or by hand pressure applied to a button, spring or other device attached to the handle of the knife."
They argue there is not button, and the other two don't apply, so it is legal. It comes down to the fact that the release mechinism is in the blade, not the handle.
I would be careful. It is a small enough technicality that charges could be laid. Although you may win it in court, it is still a hassle.
If the knife were legal, I would argue that carrying it using the pocket clip would not constitute concealed. I agree with you it isn't really concealed. While some people may not know what it is, as a Police officer, your first consideration is that it is a knife. Exterior sheath is not concealed as well.
