Benchmade 940 Osborne Malfunction?

I have owned my 940 for about a month now, and I use it every day. When I got it, the axis lock would lock the blade closed. Today when I went to use it, the blade was not locked closed. If I pull on the blade now, the axis stud will move and the knife will open. It still locks open very well. My question is, is this a malfunction, or is it just normal break-in? Also, should the knife have locked closed in the first place?
